2014 Cute Kid Contest – Official Rules

VOID WHEREVER PROHIBITED.

CONTEST PERIOD: The 2014 Cute Kid Contest (the “Contest”) begins at 12:00 a.m. Eastern Time (“ET”) on February 1, 2014 and ends at 11:59 p.m, ET on June 6, 2014 (the “Contest Period”).

HOW TO ENTER: There are two ways to enter:

ONE: Via Email: During the Contest Period, email a photo of your “cute kid” to cutekid@familymedia.com. All Entries must include: your complete name, full address, including zip code, your phone number, commissary store name, your email address, child’s name, child’s date of birth and a photo of the child who you believe is the cutest kid (the “Photo”). The child or children that appear in the Photo must be 18 years of age or younger as of November 1, 2012 and a direct relative (son, daughter, brother, sister, nephew, niece, grandchild) of an authorized commissary shopper. For each unique Photo submitted, you will receive one (1) Entry into the Contest. There is no limit to the number of Entries submitted, however each eligible Entry must be different (of same or different cute kid). All email submissions must be received by 11:59 p.m, ET June 6, 2014 to be eligible for judging. Normal Internet access, phone/usage charges imposed by your on-line/phone service will apply.

TWO: Via Mail-In: To enter via mail-in: On a plain 3” x 5” paper, hand print your complete name, full address, including zip code, your phone number, commissary store name, email address, child’s name, child’s date of birth and a 3”x5” of your child(dren), and mail your completed Entry in a hand-addressed, stamped envelope, to: 2013 Cute Kid Contest, PO Box 399, Old Bethpage, NY 11804. All mail-in Entries must be postmarked on or before May 31, 2014 and received by June 6, 2014. Mechanically reproduced or automated mailed Entries are not eligible. All Entries must be complete to be eligible. Limit of one (1) Entry per envelope. Each photo submitted will count as a separate Entry. Mailed Photos will not be returned.

ENTRY GUIDELINES:

In order to be entered into the Contest, Entrants must comply with registration instructions outlined above when submitting their Entry. If the Entry is emailed, the photo must be in one of the following formats: .JPEG, .JPG, .TIFF, .TIF or .PSD and be under 10 MB.

Photo must have been taken on or after November 1, 2013. You may NOT enter a Photo that has previously been sold for publication or advertising use. Both color and black and white Photos are eligible. Quality of eligible Photos is at Sponsor’s sole discretion. Avoid sending low quality or low resolution Photos, as they do not reproduce well. When using a digital camera, we recommend you use the “largest” or “highest quality” setting.

More than child may appear in a single Photo. When more than one child is included, the photo will count as one (1) Entry and only qualify for one (1) Prize.

If Entry is emailed, actual photos must be attached. Links to photo sharing sites or web pages will be disqualified. The Entry may not contain obscene, lewd or inappropriate images including no nudity, acts of violence or acts that appear to cause harm or are illegal/dangerous, as determined in Sponsor’s sole discretion. Any Entry Material or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entry. Therefore, images/items used in the Photo should not contain any visible logos, drawings, cartoons, phrases, trademarks or other third-party materials. Entrants may not copy or otherwise plagiarize the Entry Material from any source. Sponsor has the sole discretion to determine whether a Photo qualifies as an Entry. All Entries must be the sole, original work of the Entrants. By submitting an Entry, you hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entries for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, and/or other Sponsor-selected media). In addition, you hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. You further agree to waive any moral rights in the Entry. Automated, script, macro or robotic Entries submitted by individuals or organizations will be disqualified. If, in Sponsor’s sole discretion, the Entry appears to have resulted in any injury or bodily harm, it will be rejected. Entries must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. In such an event, Entry will be disqualified from the Contest. Any Entry not in compliance with the above and does not meet the website’s requirements will be disqualified.

All Entries become property of the FamilyMedia and will not be acknowledged. Photos can NOT be returned.

JUDGING: All eligible Entries received, will be judged on or about June 8, 2014 by Sponsor-select judges based on the following criteria: Cuteness of child(ren) in Photo (70%), Overall Appeal of Photo (30%), to determine the Seven (7) Semi-Finalists to be displayed in the July issue of Family Magazine and online at www.familymedia.com/cutekid/ and subsequently voted on online (see below for voting details). In the event of a tie, tied Entries will be rejudged by the judges based solely on photo quality and composition. Judges’ decisions are final with respect to all matters relating to the Contest. By participating, Entrants agree to these Official Rules and the decisions of the Judges, which shall be final and binding in all respects. All Semi-Finalists will be required to furnish an affidavit of eligibility as proof of being an authorized commissary shopper, as well as a publicity release for the child(ren) in the submitted photo. In the event the Entrant is not the parent or guardian of the child(ren) in the photo (i.e. Aunt/Uncle/Grandparent/etc.), the child’s parent/guardian will be required to sign the publicity release and return as directed by Sponsor.

VOTING: Beginning at 12:00 a.m. ET on July 12, 2014 and ending at 11:59pm ET October 3, 2014 (the “Voting Period”) you may visit www.familymedia.com/cutekid and vote for your favorite Semi-Finalists. The Semi-Finalist with the most votes will be determined the Grand Prize winner. The Semi-Finalist with the second highest number of votes will be determined the First Prize winner. The Semi-Finalist with the third highest number of votes will be determined the Second Prize winner. The remaining Semi-Finalists will be determined Runner Ups. In the event of a tie when determining a winner, the Sponsor will make the final determination between all the tied Semi-Finalists. The use of robotic or automatic devices for voting is prohibited and Sponsor reserves the right to nullify all such votes and to disqualify from voting the responsible individual. NOTE: Any attempt to use multiple e-mail or Facebook accounts or other tactics to enter or vote more than the stated limit may result in disqualification and all associated Entries and/or votes will be void. Entries or votes generated by script, macro, bot, commercial Contest subscription, vote-swapping sites, voting software, entering service sites or any other automated means and Entries or votes by any means that subvert the Entry/Voting process or do not conform to the spirit of these Official Rules will void the Entry/votes and may disqualify the Entrant. You may vote multiple times, but voting will be limited to 6 votes per day per household (as determined by IP address).

Winners will be notified on or before October 10, 2013. Prizes not claimed within 30 days of notification will be forfeited.

ELIGIBILITY: The Contest is open to U.S. Military members, retirees, National Guard and Reserve and their families who retain commissary and exchange (PX/BX) shopping privileges and who are legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of date of Entry. Employees and their families of Conopco, Inc. d/b/a Unilever (“Unilever”), a New York corporation located at 700 Sylvan Ave., Englewood Cliffs, NJ 07632 (the “Sponsor”),, FamilyMedia, and their affiliates, subsidiaries, brokers and personnel employed in the military commissary or exchange systems are not eligible. All federal, state and local taxes are the sole responsibility of winner (or the parent/guardian if winner is a minor in his/her state of residence). Void where prohibited by law and subject to all federal, state and local laws.

PRIZES: Grand Prize (1):$1,500 for the child appearing in the Entry. Second Prize (1): $1000 for the child appearing in the Entry. Third Prize (1): $500 for the child appearing in the Entry. Runner Up Prize (4): A $100 for the child appearing in the Entry.

All prizes will be awarded, if enough eligible Entries are received. Prizes are nontransferable and no cash substitution is allowed. Winners and all Entrants, as a condition of Entry into the Contest, agree to release and forever discharge, covenant not to sue, and hold harmless Sponsor, FamilyMedia and each of their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies and their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development, evolvement and execution of the Contest from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Contest, the receipt, ownership or use of any prize awarded, or any typographical or other error in these Official Rules or the announcement of offering of any prize.

GENERAL RULES: Potential Semi-Finalists (and the parent/legal guardian of child depicted in winning Photo, if not the same person) may be notified by email/mail and will be required to execute and return an affidavit of eligibility and liability/publicity release (where legal) and assignment of rights within seven (7) days of notification attempt or prize will be forfeited and an alternate winner selected. Return of prize notification as undeliverable may result in disqualification and alternate selection. All applicable federal, state and local taxes on the prize are the sole responsibility of winner. Winners may be required to provide an additional photo for promotional purposes, at the Sponsor’s request. Details may be provided at time of winner notification. Acceptance of prize constitutes permission to use winner’s name, likeness and winning Entry for promotional purposes without further compensation except where prohibited by law. By entering, Entrants (and their parents or legal guardians, if Entrant is a minor in his/her state of residence) accept and agree to be bound by these Official Rules. Official Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of Entry. “Authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Entry process or the operation of the Contest; violates the Official Rules; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. Entries generated by script or bot are not eligible. Sponsor is not responsible for incomplete, illegible, misdirected, damaged, lost, postage due or late mailed Entries or technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in the Contest which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in the Contest. Sponsor reserves the right to cancel, terminate or modify the email portion of the Contest if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort. In such event, Sponsor will determine the winners from the criteria listed above from among all eligible emailed Entries received prior to cancellation and all eligible mailed Entries received. Void where prohibited and subject to all federal, state and local laws. As a condition of participating in the Contest, Entrants (and their parents or legal guardians if Entrant is a minor in his/her state of residence) agree that: 1) under no circumstance will participant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will Entrant be entitled to receive attorneys’ fees or other legal costs.
